Information Notice within the Scope of the Personal Data Protection Law

 

The Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform (“Communiqué”) regulate the protection of fundamental rights and freedoms of individuals, in particular the right to privacy, in the processing of personal data, as well as the obligations of natural and legal persons who process personal data and the procedures and principles they must comply with.

 

With this Information Notice, Yetkinsoft, in its capacity as data controller within the scope of the KVKK and the Communiqué, informs visitors who visit the website at www.yetkinsoft.com.tr (“Website”), and who, when approving the Yetkinsoft User Agreement or entering the personal data requested in the “Get Information” and/or “Request Demo” sections on the Website, or who share personal data with Yetkinsoft by sending messages via e-mail, social media accounts or by other means, about how these data will be processed. With this Information Notice, Yetkinsoft also aims to inform the users of the portal (“Yetkin Portal”) covering the software modules (“Module(s)”) accessed through the Website, regarding Yetkinsoft’s personal data processing activities.

If you enter the personal data requested in the “Get Information” and/or “Request Demo” sections on the Website, or if you share personal data with Yetkinsoft by sending messages via e-mail, text message, social media accounts and applications or by other means, the following data may be processed:

 

Identity Information: First name – Last name

Contact Information: Telephone number, e-mail address

Other Information: The trade name of the company for which you request information, number of employees, your title/position in the company, and the purpose of your request.

 

In addition, for Users of the Modules accessed via the Website, in addition to the above-mentioned information, transaction data, call center voice recordings, legal transaction information and, if you carry out transactions via the Website, log record information, user ID, IP address, the relevant legal transaction information and your correspondence and file information relating to dispute processes.

Your personal data may be collected through:

  • Visiting the Website, logging into the Yetkin Portal, requesting a trial membership and information for logging into the Yetkin Portal,
  • Approving the Yetkinsoft User Agreement,
  • Being a party to other agreements within the scope of the activities of the above-mentioned Website,
  • Contacting us by sending messages via e-mail, text message, social media accounts and applications.

 

2.2. Legal Basis for Collecting Personal Data

 

Your personal data are collected in line with the purposes of processing personal data set out in Article 3 of this Information Notice, pursuant to Article 5 of the KVKK and the relevant legislation.

 

  1. Purpose of Processing Personal Data

Your personal data are processed for the following purposes:

 

  • Sale of products and services offered by Yetkinsoft;
  • Planning and execution of after-sales support services;
  • Follow-up of contract processes and legal claims;
  • Being able to contact you regarding your suggestions, complaints and requests and responding to such applications;
  • Planning and execution of activities necessary for the customization and promotion of our products and services to relevant persons according to their tastes, usage habits and needs;
  • Planning and performance of Yetkinsoft’s commercial and/or business strategies and ensuring the legal, technical and commercial/business security of Yetkinsoft and of related persons in a business relationship with Yetkinsoft;
  • Detection and elimination of software errors in Yetkin Portal and/or the Modules, improvement of the Website, conducting statistical evaluations and market research, determining and implementing commercial and business strategies;
  • Legal processes and compliance with legislation, responding to information requests from administrative and judicial authorities;
  • Ensuring information and transaction security and prevention of malicious use;
  • In addition, if you have given your consent in this regard, for use in marketing activities, product/service offers, Yetkinsoft’s current or new product development and potential customer identification.

 

If you visit the Website without logging in as a user, we process your data in the form of cookie records (IP address, browsing information, device information used (ID) and traffic data) for the purposes of ensuring information processing security and preventing malicious use, conducting activities in compliance with legislation, and fulfilling our other legal obligations towards competent and authorized public institutions and organizations.

 

  1. Measures Regarding the Protection of Personal Data

In accordance with Article 12 of KVKK, we undertake to keep your personal data confidential, to take all necessary technical and administrative measures to ensure confidentiality and security, and to exercise due care.

 

When storing your personal data, we use generally accepted security technology standards such as firewalls and Secure Socket Layer (SSL) encryption. In addition, in order to protect information systems containing personal data against unauthorized access and unlawful data processing, we take security measures such as hashing, encryption, transaction logs, access management and physical security.

 

Personal data in paper form are stored in cabinets, and only authorized persons have access to these documents.

 

Despite having taken the necessary information security measures, in the event that personal data are damaged or fall into the hands of third parties as a result of attacks on the Website and the system, this situation shall be immediately notified to the relevant data subject and to the Personal Data Protection Board.

 

  1. Persons to Whom Processed Personal Data May Be Transferred and Purposes of Such Transfer

Your personal data, in line with the purposes of data processing set out in Article 3 of this text, may be shared as follows:

 

  • Due to the use of Google Analytics on the Website, your traffic data, page visits, referral sites, visit times and durations, operating system, device and browser information may be transferred to Google LLC (1600 Amphitheatre Parkway Mountain View, California 94043 USA);
  • With third parties from whom we receive support in areas such as domestic storage, archiving, information technology support (such as server, hosting, software, cloud computing), GSM operators with whom we cooperate and/or from whom we receive services, business partners, supplier companies, banks, financial institutions, consultancy firms from which we receive support in areas such as legal, tax, dealers, and other third parties and institutions providing support in sales, marketing and other areas related to Yetkinsoft’s activities;
  • To authorized and competent private or public institutions and organizations, judicial authorities and official institutions/organizations, for the purpose of fulfilling our obligations to provide information and documents and other related obligations and to exercise our legal rights such as rights of litigation and defense;
  • To our suppliers from whom we receive consultancy services and to the relevant payment institutions, where necessary, for the purposes of monitoring and detecting suspicious transactions and preventing unlawful transactions;
  • To our business partners within the scope of activities aimed at increasing Website visit traffic.

 

  1. Your Rights as Data Subject

Pursuant to Article 11 of the KVKK, as a data subject, by applying to Yetkinsoft, the data controller, you have the right to:

 

  1. Learn whether your personal data are being processed,
  2. Request related information if your personal data have been processed,
  3. Learn the purpose of processing your personal data and whether they are being used in accordance with this purpose,
  4. Know the third parties to whom your personal data are transferred, within the country or abroad,
  5. Request rectification if your personal data are incompletely or incorrectly processed,
  6. Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
  7. Request that the transactions carried out pursuant to (e) and (f) be notified to third parties to whom your personal data have been transferred,
  8. Object to the occurrence of a result against you by means of analysis of your processed data exclusively through automated systems,
  9. Request compensation for damages in case you suffer damage due to unlawful processing of your personal data.

 

You may submit your application to Yetkinsoft:

 

  • In writing,
  • Using your registered electronic mail (KEP) address, secure electronic signature or mobile signature,
  • Using the e-mail address that you have previously notified to Yetkinsoft and that is registered in Yetkinsoft’s system.

 

Your application must contain:

 

  • Name, surname and, if the application is in writing, signature,
  • For citizens of the Republic of Turkiye, T.R. identity number; for foreigners, nationality, passport number or identity number, if any,
  • Residential or workplace address for notification,
  • E-mail address, telephone and fax number for notification, if any,
  • Subject of the request.

 

Information and documents related to the subject should be attached to your application.

 

If your application for these purposes requires an additional cost, you may be required to pay the fee determined in the tariff set by the Personal Data Protection Board. Your requests included in your application will be finalized as soon as possible and at the latest within 30 (thirty) days from the date of receipt of your application, depending on the nature of the request.
